Amendments to the Patent Act due to Bill C-13 (COVID-19 Emergency Response)

In response to the developing situation in Canada with respect to the COVID-19 crisis, the Canadian Government has passed Bill C-13, An Act respecting certain measures in response to COVID-19

Included in the emergency legislation is an amendment to the Patent Act which permits the government to use and sell patented inventions for dealing with the public health emergency. It states:

"The Commissioner shall, on the application of the Minister of Health, authorize the Government of Canada and any person specified in the application to make, construct, use and sell a patented invention to the extent necessary to respond to the public health emergency described in the application."
